No professional advice, and no engagement

Everything on this site is general information about business valuation, forensic accounting, and expert services. It is not accounting, tax, valuation, legal, or investment advice, and it is not an opinion on any matter, transaction, or set of facts.

Reading this site, sending an enquiry through it, or receiving a reply does not create an engagement, an expert relationship, or any other professional relationship with the firm. An engagement begins only when the firm and the client sign an engagement letter, after a conflict check. Do not act, or decide not to act, on anything here without professional advice about your own circumstances.

Articles and other material on this site reflect the position as we understood it on the date each was published. Standards, regulations, and case law change. We do not undertake to update anything here, and material that remains available may no longer be current.

Where an article carries an author's name, the views expressed are the author's and are not necessarily those of the firm or of any client.

Any description of prior engagements or testimony is provided for background. Prior results do not guarantee or predict a similar outcome in any other matter.

Confidential information

Do not send confidential, privileged, or sensitive information through this site or by unencrypted email. Material sent before an engagement is accepted is not treated as confidential and may not be protected. Unsolicited material may be reviewed by the firm as part of a conflict check and is not returned.

The content of this site, including text, graphics, marks, and page design, belongs to Insight Forensic and Valuation Services, LLC or is used with permission, and is protected by copyright and trademark law. You may read the site, and print or download individual pages for your own reference. You may not republish, distribute, or use the content commercially, or create derivative works from it, without written permission.

We reserve all rights in the content of this site, including the right to prevent its use for text and data mining or for training, fine-tuning, or evaluating machine learning or artificial intelligence systems. Nothing on this site is licensed for those purposes.

Acceptable use

Use the site lawfully, and do not interfere with it.

Limitation of liability

To the fullest extent the law allows, neither the firm nor its members, employees, or contractors will be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this site or your reliance on its content, including lost profits or lost data, even if the possibility of such damages was known.

To the fullest extent the law allows, the total liability of the firm and its members, employees, and contractors for any claim arising from this site or these terms will not exceed one hundred dollars. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section and the section above may not apply to you.

Any claim arising from this site or these terms must be brought within one year after the claim arises, except where a longer period is required by law.

Indemnification

You agree to indemnify the firm and its members, employees, and contractors against claims, losses, and reasonable expenses, including reasonable attorneys' fees, arising from your use of the site in breach of these terms or in violation of the law.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any dispute arising from the site or these terms will be brought in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.

Changes, severability, and contact

We may change these terms. The effective date above shows when the current version took effect, and where a change is material we will note it on the site as well. Continued use of the site after a change means you accept the revised terms. If you do not accept them, please stop using the site.

If any provision is held unenforceable, the rest remains in force.

The sections headed Confidential information, Intellectual property, No warranties, Limitation of liability, Indemnification, and Governing law continue to apply after you stop using the site.

These terms, together with the privacy policy, are the entire agreement between you and the firm about your use of this site, and replace any earlier understanding about it. If we do not enforce a provision, that is not a waiver of it. You may not assign your rights under these terms; we may assign ours in connection with a merger, acquisition, or transfer of the firm's practice. These terms are for the benefit of you and the firm, and of the people named in the sections on limitation of liability and indemnification. No one else may enforce them.
